Fundraising Partner Terms and Service Agreement

These Terms and Service govern participation in the Cookies For Dough fundraising platform. By registering as a fundraising partner, accessing the platform, or sharing fundraising links, you agree to these Terms in full.
If you do not agree, you may not participate in the Cookies For Dough fundraising program.
1. Platform Overview
Cookies For Dough is a referral based fundraising platform. Fundraising credit is earned only through tracked referrals using a fundraising partner’s unique affiliate link or links provided by Cookies For Dough.
All actions taken on the Cookies For Dough website related to fundraising are governed by referral tracking technology. Cookies For Dough does not manually assign or retroactively apply fundraising credit.
2. Fundraising Credit and Tracking
Fundraising credit is issued only for orders that are successfully tracked through a fundraising partner’s unique affiliate link.
Cookies For Dough is not responsible for orders that are placed without using a fundraising partner’s affiliate link, are placed using an incorrect, altered, or expired link, are blocked by browser settings, cookies, ad blockers, or privacy tools, or cannot be properly attributed due to technical limitations.
The tracking records maintained by Cookies For Dough are the sole and final source of truth for determining fundraising credit.
Orders placed directly on the Cookies For Dough website without proper referral tracking are not eligible for fundraising payouts.
3. No Guaranteed Earnings
Cookies For Dough does not guarantee fundraising results, earnings, conversion rates, or total revenue.
Fundraising success varies based on many factors including promotion efforts, audience engagement, timing, and market conditions. Participation in the platform does not guarantee any specific financial outcome.
4. Payouts and Compensation
Payout methods, payout timing, minimum thresholds, and payout structures are communicated during onboarding and may vary by fundraising partner.
Cookies For Dough reserves the right to modify payout terms, methods, timing, and structures at any time, with or without notice.
Payouts may be delayed or adjusted due to refunds, cancellations, failed payments, or chargebacks.
If an order is refunded, canceled, or charged back, the associated fundraising credit may be reduced or reversed.
5. Partner Eligibility and Approval
Cookies For Dough reserves the right to approve, deny, suspend, or remove any fundraising partner at its sole discretion.
Fundraising partners must be legally permitted to participate and must provide accurate and complete information during registration and onboarding.
6. Acceptable Use and Conduct
Fundraising partners agree not to misrepresent Cookies For Dough or its products, make false or misleading claims, create fake orders or attempt to manipulate tracking, self purchase for the purpose of inflating payouts, use spam, deceptive marketing, or unlawful promotion methods, run paid advertisements using Cookies For Dough branding without written permission, or violate any applicable laws or regulations.
Violations may result in immediate termination and forfeiture of unpaid fundraising earnings.
7. Brand and Intellectual Property
Fundraising partners are granted limited permission to use Cookies For Dough branding and promotional materials solely for approved fundraising purposes.
Brand assets may not be altered, misused, or combined with unapproved messaging. All intellectual property remains the property of Cookies For Dough.
8. Data and Information Storage
Fundraising partner information is stored on the Cookies For Dough website and related systems for the purpose of operating the fundraising platform, tracking referrals and payouts, communicating with partners, and meeting legal and compliance needs.
Use of the platform is also governed by the Cookies For Dough Privacy Policy.
9. Independent Relationship
Fundraising partners are independent participants and are not employees, agents, joint venturers, or legal partners of Cookies For Dough.
Nothing in these Terms creates an employment, partnership, or agency relationship.
10. Termination
Either party may terminate participation in the fundraising program at any time.
Cookies For Dough may terminate immediately for violations of these Terms or conduct that harms the platform, brand, or customers.
Upon termination, outstanding eligible fundraising credit may be paid, adjusted, or forfeited depending on the reason for termination.
11. Limitation of Liability
Cookies For Dough is not liable for indirect, incidental, or consequential damages arising from participation in the fundraising program.
Total liability, if any, shall not exceed the amount paid or payable to the fundraising partner in the six months prior to the claim.
12. Indemnification
Fundraising partners agree to indemnify and hold harmless Cookies For Dough from any claims, damages, losses, or expenses arising from their actions, promotions, or misuse of the platform.
13. Changes to Terms
Cookies For Dough may update these Terms at any time. Continued participation in the platform after changes are posted constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.
